Illinois Driver’s License Hearings Following a Fatal Crash

Car accidents are not to be taken lightly, and Illinois has a set of rules to follow if you find yourself in a potentially fatal car crash. There is an entire process that goes into effect when you’re in a car crash, including attending administrative hearings in Chicago, Joliet, Springfield, or Mount Vernon. Below are the steps to ensure you are properly handling the situation.

File a Report

Regardless of who’s at fault, the Illinois Safety and Financial Responsibility Law explains that all traffic accidents resulting in personal injury, death, or property damage in excess of $500 must be reported within ten days of the accident. You must also file a police report if damages exceed $1,500.

Liability

The Illinois Department of Transportation will investigate the accident to figure out who was involved, who was or was not insured at the time, and who is liable. It’s possible that at this step, your license will be suspended.

Who’s At Fault?

If you believe that the accident was not your fault, you can fight the suspension by requesting a hearing in writing. In order to do this, you must give the Secretary of State exactly what they ask of you in order to prove that the accident was not your fault.

Driver’s License Suspension Hearing

Even though hiring a lawyer is not required for this hearing, it is highly recommended if you can afford it. You must request a hearing by filling out a form called the Formal Hearing Request. Additionally, you’ll need to pay a $50 fee to schedule the hearing and choose if you want the hearing to take place in Chicago, Joliet, Springfield, or Mount Vernon.

What To Do If You Lose The Hearing

If you lose the hearing, you must pay for the damages by depositing money into a security deposit account or enter into an installment agreement with the other person to help you make a set amount of payments over time.
