Consuming alcohol under the age of 21 is illegal in Illinois, except for in specific circumstances usually involving parental supervision. Drinking and driving is illegal in Illinois no matter your age. Drivers under the age of 21 face a zero tolerance policy. This means that if the driver submits to a chemical test which shows their BAC is anything above .00, their license is automatically suspended.

An underage driver’s license will also be suspended if he/she refuses to submit to a chemical test.

If an underage driver has a BAC over .08, a BAC over .05 with further proof of impairment, illegal drugs in their system, or show other signs of impairment, this will result in a DUI conviction.

If an individual under age 21 is convicted of illegally purchasing alcohol, or is found in possession of alcohol, they will have their driving privileges suspended for six months for a first conviction and twelve months for a second. Their driving privileges will be revoked following any further convictions.

An individual under the age of 21 who is not convicted but instead receives court supervision for the purchase, possession, or consumption of alcohol will have their driving privileges suspended for three months.

When an underage driver faces a first time DUI conviction, it results in a minimum 2-year license revocation. A second DUI conviction results in a minimum 5-year revocation.
